Agenda Item: Greetings and introductions

Vice-Chair Scott Livingston called the meeting to order and welcomed those in attendance.

Agenda Item: Review and Approval of November Council Meeting Minutes

Vice-Chair Livingston moved that the minutes from the November meeting be approved; there was a second, and the motion passed.

Agenda Item: FY 2018 Audit Presentation – Robert Diss, Lindsey and Associates

Robert Diss was introduced. Mr. Diss is with the accounting firm, Lindsey and Associates. The Section contracts with Lindsey and Associates to conduct its annual audit. Mr. Diss presented an overview of the Section’s Fiscal Year 2018 audit, and entertained questions from the Council and residents. The audit will be available to residents for review on the Section website.

Agenda Item: Small Cell Tower Update

For the past year, the Section 5 Council has been monitoring local and national developments related to small cell deployment. To date, neither the State of Maryland nor Montgomery County has passed legislation dealing specifically with small cell deployment. Because of this, many local governments across the state are working to adopt ordinances that would establish a consistent process for the review and approval of small cell technology. Section 5 is currently working with the surrounding Chevy Chase municipalities to draft such an ordinance. The Town Manager attended a meeting with other down county municipalities on November 28 where two possible ordinance drafts were circulated. The Section will review the draft ordinances and submit comments to Section 5 attorney, Ron Bolt, by early January.

Agenda Item: Discussion of Possible Noise Ordinance

A resident recently contacted the Town Manager regarding the possibility of instituting a noise ordinance in Section 5 prohibiting construction noise before 8 AM. The call was in response to a current home demolition project. The Town Manager noted that Section 5 has traditionally followed Montgomery County guidelines which allow for a 7 AM start time on week days. There was a discussion as to the pros and cons of having a separate time from the County. It was decided that at this time, the Section would not deviate from the County regulations, but instead continue to seek cooperation from individual construction contractors and ask that they please save louder construction work until after 8 AM.

Agenda Item: Monthly Financial Report

The Town Manager presented an overview of the Section’s current financial status, and entertained questions from the Council. Vice-Chair Livingston inquired about the Section making donations to the area Chevy Chase fire and rescue squads. Chairman Chernack asked that the Town Manager report back with the specific organizations this would encompass.

-The Town Manager noted there was no additional information to report.

Adjournment

Vice-Chair Livingston adjourned the meeting. The next meeting will be held January 8, 2018, at 7:30 PM at the Village Hall, 5906 Connecticut Avenue. The Village Hall has handicapped access. Everyone is welcome.
