Minutes of the Council Meeting held Feb. 16, 2010

Time: 7:30 PM

Place: 5906 Connecticut Avenue, Chevy Chase Village Hall

Present: Karin Flynn; Alec French; Peter Gray; Frances L. Higgins; Chris Richardson; Andrew Smith; 2 Section 5 residents

  1. Agenda Item: Minutes

    Andrew moved that the January 12, 2010, Council minutes be approved as revised; Alec seconded the motion and the motion passed unanimously.

  2. Agenda Item: Discussion of Traffic Calming Devices

    There was some discussion about the lack of responses from companies interested in presenting plans for Section 5's traffic problems.

    Decision: Alec suggested that the Council wait for another month or two for companies to present their plans. The manager will contact the County about its criteria for the installation of speed humps.

  3. Agenda Item: Chris Jakubiak Presentation

    Chris Jakubiak was unable to attend this meeting because of a conflict in his schedule. He has agreed to give his presentation at the March 9, 2010, Council meeting. There was some discussion about the type announcement which will be sent to the residents concerning the Jakubiak presentation.

    Decision: The Council decided to include a separate sheet announcing Chris Jakubiak's presentation that will accompany the March agenda flyer.

  4. Agenda Item: Disscussion of an Ordinance Preventing Temporary Storage Units Being Placed on Public Streets and Length of Time These Units May Remain on Private Property

    There was some discussion about the number of temporary storage units which have been placed on private property in Section 5 over the past few years.

    Decision: The manager will contact the abutting municipalities and obtain a copy of their ordinances precluding temporary storage units being placed on private property.

  5. Agenda Item: Discussion of Reducing the Speed Limit on Section 5's Streets

    There was some discussion about the process which Section 5 needs to follow before enacting a speed limit for its streets. The manager reported that the Village of Chevy Chase has a 25 mph speed limit on its interior streets, Martin's Additions a 20 mph speed limit and the Town of Chevy Chase a 25 mph speed limit.

    Decision: The manager will contact the proper authorities, either County or State, to determine the steps which must be followed to set the speed limits for Section 5. She will include a copy of the following proposed ordinance with the March 9, 2010, Council agenda: "No motor vehicle shall be operated upon any public highway, street, roadway, or alley of Section 5 of the Village of Chevy Chase at a speed exceeding 20 miles per hour."

  6. Agenda Item: Discussion Proposed Ordinance Preventing Discharge of Water from Private Property onto Public Sidewalks and Streets

    This winter the extreme cold has caused some water discharge from private property to freeze on public sidewalks. A resident has surveyed the properties in Section 5 and determined that many properties have a water discharge onto public sidewalks from a variety of sources. There was some discussion about who is liable for any injury which may be suffered from falling on ice which may result from these water discharges.

    Decision: Alec will contact LGIT, Section 5's insurance company, to determine if Section 5 is liable for any injuries resulting from ice on public sidewalks which are caused by water discharges from private property onto public sidewalks.

  7. Agenda Item: Discussion Proposed Ordinance Limiting the Amount of Non-Vegetative Surfaces in Front Yards

    There was some discussion concerning what constitutes a front yard and what is considered non-vegetative surfaces. Approximately 28 % of residents responded to the zoning survey and 60% expressed an interest in some regulation of non-vegetative surfaces in front yards.

    Decision: Andrew agreed to do some research into what constitutes a front yard and what are some non-vegetative surfaces and report to the Council at the March 9, 2010, Council meeting.

  8. Agenda Item: Treasurer's Report

    Karin said that Section 5 revenues are considerably less this fiscal year as compared to last fiscal year. Karin said that the cost of snow removal this winter has exceeded the amount in the budget but she said that this is money well spent. The Council placed a $7,000 item under personnel in the 2009-10 for a raise for the manager; however, the percentage of this raise for the manager was never determined. Karin will determine the amount of taxes which Section 5 will pay for the manager's raise and report this to Andrew and Chris.

    Decision: She will create a budget for both revenues and expenditures for fiscal year 2010-11 and send it to the Council members for discussion at the March meeting. The manager will contact the State to determine the amount of Section 5's income tax check for February and report to Karin.

  9. Agenda Item: Manager's Report

    The manager will contact the fire department about a device which may be placed on the fire hydrants to designate their locations. This device will alert the snow shoveling crew about the existence of the hydrants and allow them to be shoveled out

    The manager will contact the resident at 6 Leland Ct. and tell him that he does not need a permit to widen his driveway.

    The manager explained to the Council that some Maryland municipalities are concerned about the State borrowing money from the municipalities' income tax funds. The State has reported that it will repay these loans.

    The manager is creating a map which will chart the location of the fire hydrants and storm drains so that when there are large amounts of snowfall, the hydrants and drains may be located.

    There is a property at 7203 Brookville Road which is for sale. There was some discussion about Section 5 purchasing the lot in the rear and creating a park. It was suggested that Section 5 use its money from the Open Space Fund to help with the purchase.

    Decision: Alec will contact the real estate agent at 7203 Brookville Road to determine the price of the lot and report back to the Council.

  10. Agenda Item: Adjournment Andrew moved that the meeting adjourn. The next meeting will be March 9, 2010, at 7:30 PM at the Chevy Chase Village Hall, 5906 Connecticut Avenue. Everyone is welcome.
