SECTION 5 OF THE VILLAGE OF CHEVY CHASE
COUNCIL MEETING MINUTES
Date: December 14, 2010

Present: Alec French; Peter Gray; Frances L. Higgins; Chris Richardson; Andrew Smith; 12 Section 5 residents; 1 Hamlet Association resident

Agenda Item: Minutes
Andrew moved that the November 9, 2010, Council minutes be approved as revised; Peter seconded the motion and it passed unanimously.
Greg Shron, the County representative who was to provide information concerning the topic, "Rebuilding Montgomery County Together", was unable to attend the meeting.

Agenda Item: Discussion of Traffic Calming Devices
Andrew said that Karin was unable to attend the meeting and asked that the Council wait until the January Council meeting to discuss her letter and survey form which will be sent to the residents. This letter and survey form will solicit residents' opinions concerning the Council continuing with its efforts to install speed humps and/or limited access to Section 5's streets.
Peter had previously sent some additional questions concerning the installation of speed humps and/or limited access to Section 5's streets to Joe Cutro, a traffic engineer. Peter read his questions and Cutro's responses. There was some discussion of these questions and answers.
Decision:
The manager will have the web master post these questions and answers on Section 5's web site. -
Agenda Item: Presentation of Proposed Ordinance Limiting
the Amount of Non-Vegetative Surfaces in Front Yards
Andrew said that only 30 percent of Section 5 residents responded to the zoning survey and approximately 60 percent of these respondents stated that they would like the Council to address the issue of limiting the amount of non-vegetative surfaces in front yards. Andrew and Peter wrote an ordinance limiting the amount of non-vegetative surfaces in front yards. There was some discussion of the definition of a front yard. Andrew read the preliminary ordinance.
Decision:
Peter moved that this preliminary ordinance and the letter explaining it to the residents be sent to Section 5 residents. Andrew seconded the motion and it passed unanimously. Andrew will send a copy of the preliminary ordinance and also the letter explaining the ordinance to the manager and she will send this material to the residents. -
Agenda Item: Police Patrols
The manager has contacted the County attorney about the status of the police patrol contract which Section 5 has signed and sent to the County. The County attorney explained to the manager that he has sent the two copies of this contract to the police contact person for his signature; however, the County attorney has not heard from this person.
Decision:
The manager will continue to contact the County attorney concerning the status of this contract. -
Agenda Item: Building Inspector's Report
Permit granted:

Agenda Item: Manager's Report
A Woodbine St. resident contacted the manager about the water which collects on the west side of the public sidewalk on Glendale Rd. and freezes in the winter. The resident is concerned about the liability which Section 5 assumes if it allows this to continue. Section 5 has recently replaced some sections of the public sidewalk on the west side of Glendale Rd. where this water collects and this replacement has corrected some of this problem.
Decision:
The Council will continue to monitor this situation and correct the hazard.A Woodbine St. resident has replaced his driveway without a permit and with an impervious surface. The Council has notified this resident about this infraction; the resident has acknowledged this infraction.
Decision:
The manager will contact the abutting municipalities about their ordinances which address the issue of residents who build without a permit. She will report to the Council about her findings.Peter said that the new organization, Chevy Chase At Home, would like to give a presentation at the February, 2011, Council meeting. This presentation will explain the benefits of this organization to Section 5 residents and solicit an appeal for new members, volunteers and funds.
Decision:
The Council agreed to allow a representative from Chevy Chase At Home to give a presentation at the February 2011 Council meeting.A Section 5 resident asked the Council if it would send a notice about a group of Section 5 children who go house to house to collect food for the Montgomery County Food Bank on Martin Luther King's holiday.
Decision:
The Council agreed to send a notice to Section 5 residents concerning the food drive when it sends the preliminary ordinance on non-vegetative surfaces. -
Adjournment
Andrew adjourned the meeting. The next Council meeting will be Tuesday, January 11, 2011, at 7:30 PM at the Village Hall, 5906 Connecticut Avenue. There is handicapped access to the hall. Everyone is welcome.
